The Illinois Workers Compensation Commission issued an emergency amendment to the Illinois Workers Occupational Diseases Act that creates a rebuttable presumption for frontline workers who contract COVID-19. The amendment expands the definition of frontline workers beyond first responders and health care workers to include a broad variety of employees, including grocery and pharmacy workers. The amendment states that when a frontline worker is incapacitated by COVID-19 during a state of emergency, it is presumed that the exposure arose in the course of the worker’s employment and is causally connected to the hazards of the worker’s employment unless proven otherwise. The emergency rule will expire in 150 days.
